Highway App, Inc. exists to make freight more connected and secure. We do that by establishing trusted, digital relationships. A fundamental part of establishing that trust involves providing users of our services with transparency into how their data is collected, used, and disclosed.
This Privacy Notice describes how Highway App, Inc. (“Highway,” “we,” or “us”) collects, uses, discloses, and otherwise processes information about you. Highway is a platform that connects our customers (“Customers”) with trucking businesses. Our platform includes multiple products to help Customers search for trucking companies (“Carriers”) who meet their specifications, share logistics-related content, validate Carrier identities to meet their compliance needs, and protect against fraud. It also provides our Carrier users with tools to engage with a network of participating Customers in the transportation sector to help them build their business. Each of these offerings are collectively referred to as the “Services.”
This Privacy Notice applies to information we collect about personnel associated with Carriers, Customers, and those who may download, access or use our websites, (the “Website”), without otherwise using our Services (“Visitors”).
We do not provide our Services to individual consumers and we do not collect information about or from individual consumers.
This Privacy Notice is effective as of the “Last Updated” date above. We may change this Privacy Notice from time to time. If we make changes, we will notify you by revising the “Last Updated” date. Where required by law, we will notify you of changes through the Services or by other means and seek your consent to or allow you to opt for the changes. COLLECTION OF INFORMATION
The information we collect about you depends on how you interact with us. In this section, we describe the categories of information we collect and the sources of this information.
Information You Provide to Us
We collect information you provide directly to us. For example, we collect information directly from you when you register for and use the Services, onboard to the Services or with a Customer (if you are a Carrier), visit our Website, fill out forms or surveys, post information on our Website, request customer support, or otherwise communicate with us. Depending on your relationship with us when you use the Website or the Services, the type of personal information we collect may vary. The types of information we collect directly from you may include:
Contact Information, such as your name, email address, mailing address, phone number, Motor Carrier (MC) Number, and Department of Transportation (DOT) Number. If you are an individual associated with a Carrier, in addition to the above, we may also collect additional information from you or individuals associated with your business such as your commercial driver’s license or government ID, photos or videos, Vehicle Identification Number (VIN), your business’s Tax Identification Number (TIN), and utility or bank account information (for identity validation purposes);
Biometric Data, if you are required to verify your identity through our Services, our vendor may collect data about your face from images of you and your driver’s license or government ID that may be considered biometric data under some laws (for more information, see the Biometric Data section below);
Geolocation Information, such as information about a Carrier-affiliated vehicle's location or the location of a specific contracted vehicle within your fleet, if you choose to provide it to us or give us or a Customer access to information generated by your vehicle's Electronic Logging Device (ELD).
Financial Information, such as your organization's bank details or a Carrier-preferred payment method within an onboard;
Employment Information, such as your job title, TFIN, and name of employer;
We also collect information included in your communications with us, including sending a message submitted through our Website. We may also collect any other information you choose to provide.
Information We Collect Automatically
We automatically collect certain information about your interactions with our Website and our Services, including:
Internet and Activity Information: We collect information about how you access our Website, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, and browser type. We also collect information about your activity on our Website and interaction with our communications, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Website.
Audio Information: If you call our customer service team or otherwise communicate with us, we may monitor, record, and retain those conversations.
Precise Geolocation Information: If you are a Carrier, with your consent, we may automatically collect information about the precise location of your device or vehicle, including through your ELD. You may stop the collection of precise location information at any time (see the Your Privacy Choices section below for details) but note that our and our Customers’ compliance needs may require us to track location of contracted Carriers so limiting that may impact the ability for our Customers to work with you.
Information Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies and pixels, to collect information about your interactions with our Website and communications. These technologies help us improve our Website and communications, see which areas and features of our Website are popular, count visits, and track clicks. You may be able to adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Services.
Information We Collect from Other Sources
When you use our Services, we may obtain information about you from other sources. If you are a Carrier, with your consent, we may receive location information or route-related telematics about you or your vehicle from third parties to provide visibility into your journey. For example, we may collect your location information through your ELD connection from a third party ELD provider. We also collect information about you that is publicly available, such as information on your Department of Transportation registration or as listed with the Federal Motor Carrier Safety Administration, in order to help improve the completeness of your profile. We also collect information about you from identity verification services.
Whether you are a Carrier, Customer, or Visitor, we may also supplement the information we collect from you with information we obtain from data analytics providers, and mailing list or lead generation providers. We may also collect information you share when you interact with us on social media platforms like LinkedIn.
USE OF INFORMATION
We use your information for various purposes, including to provide, maintain, and improve the Services and Website. We also use your information for the following business and commercial purposes:
- To verify your identity and eligibility to use the Services or to meet Customer requirements, if you are a Carrier;
- When it is necessary for the general functioning of the Services, including to facilitate payment or to contact you;
- When it is necessary in connection with any contract you have entered into with us (including our Terms of Service) or to take steps prior to entering into a contract with us;
- To personalize your experience with us;
- To send you technical notices, security alerts, support messages, and other transactional or relationship messages;
- To send you marketing communications;
- To target advertisements to you on third-party platforms and websites as described in the “Targeted Advertising and Analytics” section below;
- To monitor and analyze trends, usage, and activities in connection with our products and services;
- To detect, investigate, respond to, prosecute, and help protect against security incidents and other malicious, deceptive, fraudulent, or illegal activity, and help protect the rights and property of Highway and others;
- To comply with our legal and financial obligations; and
When we have obtained your prior consent.
TARGETED ADVERTISING AND ANALYTICS
We engage others to provide analytics services, serve advertisements, and perform related services across the web and in mobile applications. These entities may use cookies, web beacons, device identifiers, and other technologies to collect general information about your use of our Website and other websites, including your IP address, web browser, pages viewed, links clicked, and time spent on pages. This information is used to deliver advertising targeted to you on other companies’ website and mobile apps, understand the effectiveness of this advertising, analyze and track data, determine the popularity of certain content, and better understand how people use our Website. Depending on where you reside, you can opt out of ad targeting through cookies and similar technologies on our Website by following the prompts behind the “Your Privacy Choices” link in the footer. DISCLOSURE OF INFORMATION
A core part of our Services involves connecting our Carriers and Customers, which invariably involves making certain information you provide to us or that we otherwise obtain about you, available to users of the Services. For example, when you populate your account profile, you direct us to make that information available to users of the Services, including Customers, who will be able to engage with you.
We disclose the categories of information described above as follows:
Vendors: we disclose information to vendors, service providers, contractors and consultants that need this information to provide services to us or to aid us in providing the Services to you, such as companies that assist us with web hosting, payment processing, fraud prevention, identity validation, customer service, data enrichment, analytics, and marketing.
Advertising Partners: we disclose information to third parties for the purposes described in the “Targeted Advertising and Analytics” section above when you interact with the Website.
Professional Advisors: we disclose information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
Other Users of the Services: depending on how you use the Services, we may disclose your information to other users as necessary to provide the requested Services. For example, we disclose certain information about Carriers to Customers in connection with providing the Services and so Customers can contact Carriers (e.g., information within your profile). If you are a Customer, we may make certain information you provide to the Services available to Carriers, including to allow them to contact you.
Third-Party Business Partners: With your consent, we disclose information about you to third parties, such as our Customers, including for their own marketing purposes. To withdraw your consent, contact privacy@highway.com.
Integration Partners: If you choose to use third party integrations we offer on our Services, such as with our partners, we provide certain information to the integration partners.
Legal Authorities, Individuals Involved in Legal Proceedings, and others to Protect the Rights of Highway and Others: we may disclose information to legal authorities and others for the Protection and Compliance purposes described above, including if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements and if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Highway, our users, the public, or others.
Corporate Transactions: we reserve the right to disclose information as permitted by applicable laws in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
Corporate Affiliates: we reserve the right to disclose information between and among Highway and any current or future parents, affiliates, subsidiaries, and other companies under common control and ownership.
Consent: we may disclose information when we have your consent or when you direct us to do so. For example, if you are a Carrier, we disclose certain information you provide to the Services to our Customers, at your direction, including in order to allow Customers to monitor your progress on a haul or to notify you of any logistical changes.We also disclose de-identified information that cannot reasonably be used to identify you.
DATA RETENTION
We store personal information we maintain about you, including if you have an account on our Services, for as long as necessary to carry out the purposes for which we originally collected it and for other business purposes explained in this Privacy Policy. However, we will take reasonable steps to destroy or permanently de-identify personal information we hold if it is no longer needed for the purposes for which it was collected.
BIOMETRIC DATA
To verify your identity and prevent fraud, you may be required to upload an image of yourself and your government-issued photo ID. This service is provided by our vendor and its service providers (“Verification Vendor”), which will collect and process your personal information, including images of you and your government-issued photo ID and data about your face that may be considered biometric data under some laws, to verify your identity, prevent fraud, and improve our Verification Vendor’s platform. Your biometric data will be stored for no more than 3 years and then will be permanently deleted, unless otherwise required to be retained longer by law. YOUR PRIVACY CHOICES
Account Information
You can access and correct certain information stored within your Highway account (My Account) at any time by contacting privacy@highway.com, but please note that our ability to fulfill your request may be dependent on the use case.
Precise Location Information
If you are a Carrier and initially consent to our collection of your location information or instruct us to share your location information with a Customer, you can subsequently stop the collection of this information at any time by contacting eldservice@highway.com or otherwise deactivating the integration from within your ELD account. Please note, however, that certain of our Customers may require visibility into your vehicle’s location in order to be eligible to service their contracts.
Cookies and Similar Tracking Technologies
We use cookies and similar tracking technologies, as described above, on our Website. You can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting all cookies could affect some of the functionality of our Website, such as your ability to easily log in if you reject authentication cookies.
Communications Preferences
You may opt out of receiving promotional emails from Highway by following the instructions in those communications or by contacting us at service@highway.com. If you opt out, we may still send you non-promotional emails, such as those about your account.

Categories of Information Collected and Disclosure of Personal Information for Business Purposes
As required by certain California law, we use the table below to explain the categories of information we collect and the categories of recipients to whom we have disclosed that information.
We collect precise geolocation information and biometric data that is considered “sensitive” under California law but we do not use or disclose sensitive personal information to infer characteristics about you.
Sources of Personal Information
As described in the “Collection of Information” section above, we collect personal information from various sources, including directly from you, automatically when you access or use our Services, and from third-party sources.
Purpose for Collecting Personal Information
We collect personal information for the business and commercial purposes described in the “Use of Information” section above, including to provide and improve the Services and Website, for identity verification and payment processing, for marketing and other communications, and for security and legal compliance purposes.
Notice and Opt out of Sales and Sharing
We disclose, and in the past 12 months have disclosed, Identifiers, Internet Activity Information, and Derived Information to our Vendors and Advertising Partners (including social media platforms) to show you targeted ads on third-party properties and expand the reach and effectiveness of our own marketing campaigns. These disclosures may be considered “sales” or “sharing” under California law. We do not engage in sales, sharing, or targeted advertising using personal information about consumers we know to be under the age of 16, or higher age where required by law.

Access, Correction, and Deletion
You have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information.

To authenticate your request, we may ask you to verify your email address and/or provide information related to your recent interactions with us. We note that some of the information we collect is “publicly available information” which is not personal under California law. Such information is not subject to access or deletion requests.
Nondiscrimination
You have the right not to be discriminated against for exercising any of your privacy rights.
Authorized Agents
You may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify their own identity or confirm the authorized agent has permission to submit the request. Canada
This section applies to Canadian residents. In this section, personal information means information about an identifiable individual, or information that when combined with other, readily available information, may be used to identify an individual.
Transfers out of Canada/Quebec
Note that personal information may be stored, accessed, used and otherwise processed inside and outside of Quebec and/or Canada. When personal information is located outside Quebec and/or Canada, it may be subject to laws that have different standards of protection and may allow for foreign law enforcement and governmental access.Access and Correction We will take reasonable steps to ensure the personal information we hold is accurate, complete and up-to-date. Upon your written request, and subject to certain exceptions provided by law, we will inform you of the existence, use, and disclosure of your personal information and give you access to that information. We may charge a minimal fee for providing such access to you. If you believe that the personal information that we hold about you is not accurate or complete, you may write to us at privacy@highway.com. Withdrawal of Consent
You may withdraw your consent at any time to the collection, use, disclosure, or transfer of your personal information by contacting us at privacy@highway.com. If you withdraw your consent (or if you decide not to provide certain personal information), you acknowledge that we may not be able to provide you, or continue to provide you, with certain products, services, or information that may be of value to you.

Communications Preferences
We will only send you commercial electronic messages (“CEMs”) where we have your express or implied consent to do so.
